The frontal structure suffered severe damage, destroying the vehicle; however, the air bags failed to deploy. The driver was transported to the hospital via emergency medical services with back and neck injuries, including a fractured cervical spine. A police report was taken at the scene, and the vehicle was towed.
The Forward Collision Avoidance system activated and the vehicle came to an abrupt stop. Due to the failure, the contact was rear-ended by the vehicle behind. No air bags had deployed due to the failure. A Police report was filed. There was no injury sustained. The vehicle was driven away from the scene.
When hitting the pot hole, our SUV seemed to leap forward a bit and when the brakes were applied to slow and stop, the braking system failed (appeared to freeze) and the brakes did not work, and because the braking didn’t work, our vehicle hit the car in front of us.
The contact stated that while driving at various speeds, the Forward Collision Avoidance Assist (FCA) warning light was intermittently illuminated. The dealer was notified of the failure and attributed the issue to inclement weather.
My client lost her right eye and suffered a brain injury when an aftermarket rhinestone emblem decal from her steering wheel shot into her face during a low-impact crash with a deer.
This sudden stoppage caused myself and my passenger to be thrown forward harshly against the seatbelts. Additionally I was unable to steer the vehicle towards the side of the road as the wheel had locked and avoid an SUV that was rapidly approaching my rear. This SUV subsequently rear ended me.
